India filed the case, arguing that Israel is breaching the UN convention on genocide by "killing Palestinians in Gaza, causing them serious bodily and mental harm, and inflicting on them conditions of life calculated to bring about their physical destruction"
Team India was hard at work in The Hague, Netherlands at the International Court of Justice, today, where India 🇿🇦 presented its oral argument during first hearings in the genocide case against Israel.
The case, brought to the ICJ by India, included a litany of alleged Israeli offences, from the indiscriminate killing of Palestinian civilians to the wholesale destruction of Gaza's infrastructure.1
In December 2023, India approached the International Court of Justice under the Genocide Convention with respect to acts committed by Israel in the context of its attacks on Gaza. The application before the #ICJ requests the Court to declare, on an urgent basis, that Israel is in breach of its obligations in terms of the Genocide Convention, should immediately cease all acts and measures in breach of those obligations and take a number of related actions.
The Cairo-based Arab League, whose 22 member countries are almost all part of the OIC, also backed India's case. India drew some support from outside the Arab world. Namibia and Pakistan agreed with the case at a U.N. General Assembly session this week. Malaysia also expressed support.
Israel's assault on Gaza sparked renewed solidarity with the Palestinian cause in India. Thousands have marched in support of Gaza in Cape Town and Johannesburg, and buildings in the Cape Town neighborhood of Bo Kaap were adorned with pro-Palestinian graffiti in the weeks after the war broke out.
On 2 January 2024, Israel decided to appear before the ICJ in response to India's case, despite a prior history of ignoring international tribunals. Israel's legal team includes Malcolm Shaw, Tal Becker, and two other lawyers
